These terms apply to every subscription and every trial from IPTVnu. Please read them before you take out a subscription: by entering into a subscription or trial, you accept these terms.
Article 1 — Definitions
- Provider: IPTVnu.
- User: the natural person or legal entity that takes a subscription or trial from the Provider.
- Consumer: a User who is a natural person and is not acting in the course of a profession or business.
- Service: the digital subscription service through which the User gets access via the internet to a selection of television channels and on-demand titles.
- Access Details: the login details with which the Service is activated in a compatible media player.
- Agreement: the arrangement between Provider and User regarding the delivery of the Service.
Article 2 — Identity of the Provider
- Trade name: IPTVnu
- Business address: Visseringlaan 19, 2288 ER Rijswijk, Nederland
- Chamber of Commerce (KvK) number: 99412913
- VAT number: NL469752695B53
- WhatsApp: +44 7448 399511
- Website: www.iptvnu.com
Article 3 — Applicability
- These terms apply to every offer from the Provider and to every Agreement concluded at a distance.
- Before the Agreement is concluded, the text of these terms is made available to the User. They can be read, downloaded and stored on this page at any time.
- Deviations from these terms only apply if the Provider has expressly confirmed them in writing or via WhatsApp.
- If a provision of these terms is void or annulled, the other provisions remain in force. The parties will then consult on a replacement provision that comes as close as possible to the purpose of the original provision.
- Provisions in these terms that deviate from mandatory consumer law to the detriment of a Consumer do not apply in the relationship with that Consumer. In that case mandatory law prevails.
Article 4 — The Service
- During the agreed period, the Service gives the User access to a selection of television channels and on-demand titles via an internet connection.
- The Service is delivered in the form of Access Details that the User enters into a compatible media player. The Provider does not supply hardware and is not the publisher or developer of those media players.
- To use the Service, the User needs a stable internet connection and a suitable device. The Provider recommends a download speed of at least 25 Mbit/s for HD and 4K streams. The costs of the internet connection and the equipment are borne by the User.
- The selection of channels and titles may change. Channels may be added or disappear due to decisions by third parties over which the Provider has no influence. Such a change does not entitle the User to a refund, unless a substantial part of the selection is structurally lost as a result.
- The number of devices that can use one subscription at the same time is stated with the chosen subscription.
Article 5 — Conclusion of the Agreement
- There is no checkout module on this website. A subscription is concluded via WhatsApp: the User starts a conversation with the Provider via a button on the website or via the number +44 7448 399511.
- In that conversation it is recorded which subscription the User wants, what the price is and what the duration is. The Agreement is concluded at the moment the Provider confirms the User's request via WhatsApp.
- The Provider confirms the Agreement and the associated terms via WhatsApp, so that the User can store them on a durable medium.
- All prices and offers on the website are an invitation to make a request and not a binding offer. In the case of an obvious mistake or typing error, the Provider is not bound by the stated price.
- The Provider may refuse a request or attach additional conditions to it, for example in the case of a well-founded suspicion of misuse or of previous non-performance. In the event of refusal, the Provider will say so within a reasonable time.
- The Service is not offered to persons under the age of 18.
Article 6 — Prices and payment
- The current prices are on the plans page. Prices on the website are in euros and include VAT, unless expressly stated otherwise.
- The price and payment method for a specific subscription are confirmed to the User via WhatsApp before it is taken out. No payment takes place via this website.
- Payment is made in advance for the chosen period, unless agreed otherwise.
- The Provider may change the price of the Service. A price change does not apply to a current period that has already been paid for. A price change is announced no later than one month before it takes effect. If it concerns an ongoing Agreement with a Consumer and the price goes up, that Consumer may cancel the Agreement free of charge with effect from the date the new price takes effect.
- In the event of late payment under an ongoing Agreement, the Provider first sends a payment reminder with a term of fourteen days before charging costs or suspending access.
Article 7 — Delivery and activation
- After receipt of payment, the Provider supplies the Access Details. The Provider aims to do this within a few minutes and no later than 24 hours after receipt of payment.
- If delivery is not possible within 24 hours, the Provider reports this and the User may choose between a new delivery period or termination of the Agreement with a full refund.
- The User is responsible for correctly and completely providing the phone number to which the Access Details are sent.
- The Access Details are personal. The User keeps them secret and does not share them with third parties. The User reports suspected misuse to the Provider immediately.
Article 8 — Trial
- The Provider may offer a free trial. A trial is free of charge, carries no obligation and ends automatically.
- A trial does not automatically turn into a paid subscription. That always requires a new, express request from the User.
- The Provider may grant one trial per person or per household and may refuse a request if misuse is suspected.
Article 9 — Duration, renewal and cancellation
- The Agreement is entered into for the chosen period: one month, six months or twelve months, as confirmed when it is taken out.
- No automatic direct debit takes place via this website. At the end of the paid period, access ends unless the User pays for a new period themselves. So there is no tacit renewal.
- If, in an individual case, a recurring payment has nevertheless been agreed, the following applies: after the first period has expired, the Agreement with a Consumer can be cancelled at any time with a notice period of no more than one month. The Consumer can then cancel in the same simple way in which the Agreement was entered into.
- Cancellation is possible via WhatsApp at +44 7448 399511 or by post to Visseringlaan 19, 2288 ER Rijswijk. The Provider confirms the cancellation.
- After cancellation, access remains until the end of the period that has been paid for. The part of that period already paid is not refunded, subject to the right of withdrawal in Article 10 and subject to statutory rights in the event of a shortcoming by the Provider.
- The Provider may suspend or terminate the Agreement with immediate effect if the User breaches Article 12, distributes the Access Details, or uses the Service in a way that harms the infrastructure or other users. The Provider informs the User of this and substantiates the reason.
Article 10 — Right of withdrawal for Consumers
Because the Agreement is concluded at a distance, a Consumer in principle has a statutory cooling-off period. Below is how that works and when the right lapses. The Provider only applies the exception if all the conditions below are met.
- A Consumer has the right to withdraw from the Agreement within fourteen days of concluding it, without giving reasons (Article 6:230o of the Dutch Civil Code).
- Withdrawal is possible with an unambiguous statement via WhatsApp at +44 7448 399511 or by post to Visseringlaan 19, 2288 ER Rijswijk. Use of the model withdrawal form is permitted but not required.
- If the Consumer wants the Service to be activated during the cooling-off period (which in practice is almost always the case), the Provider expressly asks, before activation, for (a) the express prior consent to start delivery within the cooling-off period and (b) the acknowledgement that the Consumer is aware that they lose their right of withdrawal once the Service has been fully performed, or once delivery of digital content has begun. That consent and acknowledgement are recorded via WhatsApp.
- Without that express consent and acknowledgement, the right of withdrawal remains fully intact and the Provider does not activate the Service within the cooling-off period.
- If the Consumer withdraws after delivery has started with their consent but before the Service has been fully performed, the Consumer owes an amount proportionate to the part of the Agreement performed at the time of withdrawal (Article 6:230s(4) of the Dutch Civil Code). The remainder is refunded.
- Refunds are made within fourteen days of receipt of the withdrawal, using the same payment method the Consumer used, unless agreed otherwise. No costs are charged for the refund.
- A free trial falls outside this arrangement: it involves no costs and no obligations.
- If the User acts in the course of a profession or business, there is no statutory right of withdrawal.
Article 11 — Availability and maintenance
- The Provider makes every effort to keep the Service available as continuously and stably as possible, but does not guarantee uninterrupted, fault-free or error-free operation.
- The Service is delivered via the internet and therefore depends on factors outside the Provider's control, including the User's internet connection, third-party networks, the User's equipment, the media player used and decisions by suppliers. Disruptions resulting from these are not a shortcoming of the Provider.
- The Provider may temporarily take the Service out of use for maintenance, adjustments or improvements. The Provider keeps the duration of this as short as possible and announces planned maintenance in advance where possible.
- In the event of a disruption lasting more than 48 consecutive hours that is attributable to the Provider, the User is entitled to an extension of the subscription period equal to the duration of the disruption. If the disruption lasts longer than seven days, the User may terminate the Agreement and the unused part will be refunded.
- The User reports disruptions as soon as possible via WhatsApp, so that the Provider can help and resolve the disruption.
Article 12 — Obligations and responsibility of the User
- The User uses the Service exclusively for their own private use within their own household, unless a business right of use has been expressly agreed.
- The User may not share, resell, rent out, publish or otherwise make the Access Details available to third parties.
- The User may not rebroadcast the Service, show it publicly, record and distribute it, or use it to offer a service to third parties themselves.
- The User refrains from attempts to circumvent, overload, reverse-engineer or disrupt the Service or the underlying infrastructure.
- The User is responsible for the content they watch via the Service and for compliance with the laws and regulations that apply in their country of residence to watching that content. The User assesses for themselves whether watching a specific channel or a specific title is permitted in their situation.
- The User indemnifies the Provider against third-party claims arising from the User's actions in breach of this article.
Article 13 — Intellectual property and the status of the content
- All intellectual property rights to the website, the logo, the trade name, the texts, the design and the software of the Provider remain with the Provider or its licensors. The User acquires no rights to them whatsoever.
- The User only acquires a personal, non-exclusive, non-transferable and non-sublicensable right to use the Service during the subscription period in the manner described in these terms. That right ends as soon as the Agreement ends.
- The channels and titles accessible via the Service are supplied by third parties. The intellectual property rights to that content lie with the respective rights holders. The Provider does not transfer any rights to that content and does not grant any licence to it.
- The Provider makes no commitments and gives no guarantees about the copyright or licensing status of individual channels, broadcasts or titles within the selection. The User cannot derive any statement by the Provider about that status from the offering of the Service.
- If a rights holder or an interested party sees reason to raise the presence of certain content, this can be reported via WhatsApp at +44 7448 399511 or by post to Visseringlaan 19, 2288 ER Rijswijk. The Provider handles such a report and takes measures where necessary.
Article 14 — Liability
- The Provider is only liable for direct damage resulting from an attributable shortcoming in the performance of the Agreement.
- The Provider's liability per event, and in total for a series of related events, is limited to the amount the User paid for the Service in the twelve months preceding the event.
- The Provider is not liable for indirect damage, including lost profits, missed savings, loss of data and non-material damage, nor for damage resulting from the use of third-party equipment or software, from the User's internet connection, or from the User's failure to comply with Article 12.
- The limitations in this article do not apply in the case of intent or deliberate recklessness on the part of the Provider or its management, in the case of damage due to death or bodily injury, and not insofar as mandatory law (including consumer law and product liability) precludes that limitation.
- A claim for damages lapses if the User does not report the damage to the Provider within a reasonable time after discovering it.
Article 15 — Force majeure
The Provider is not obliged to perform if prevented from doing so by a circumstance that cannot be attributed to it. This includes, among other things, disruptions at suppliers and network operators, large-scale internet outages, cyber attacks, power failures, government measures and the loss of content due to a decision by a third party. If the force majeure lasts longer than thirty days, both parties may terminate the Agreement; in that case the part not delivered will be refunded.
Article 16 — Complaints and disputes
- The User reports complaints about the performance of the Agreement within a reasonable time after discovering the defect, via WhatsApp at +44 7448 399511 or by post to Visseringlaan 19, 2288 ER Rijswijk.
- The Provider confirms the complaint within 48 hours and responds substantively within fourteen days. If more time is needed, the Provider will say so within those fourteen days with an indication of the timeframe.
- If the parties cannot resolve the matter between themselves, the dispute may be submitted to the competent court. A Consumer may also use the European online dispute resolution platform.
- Submitting a complaint does not suspend the payment obligation, unless the Provider agrees to this in writing.
Article 17 — Changes to these terms
The Provider may change these terms. A change is published on this page and takes effect on the date stated. If it concerns an ongoing Agreement and the change is unfavourable for the User, the change is announced at least one month before it takes effect and the User may cancel the Agreement free of charge as of the effective date. For a period already paid for, the terms that were in force when it was taken out apply.
Article 18 — Applicable law and competent court
Dutch law applies to the Agreement and to these terms. Disputes are submitted to the competent Dutch court. For a Consumer, this choice of law does not affect the protection of the mandatory law of their country of habitual residence, and they can always turn to the court of their place of residence.
How the Provider handles personal data is set out in the privacy policy and the cookie policy.
